Acceptance of these terms
These Terms of Service (“Terms”) apply to your use of the BrainPilot website at brainpilot.team and the BrainPilot app at app.brainpilot.team (together, the “Service”), which are provided by BrainPilot (“we”, “us”, “our”). By creating an account or using the Service you agree to these Terms and to our Privacy Policy and Refund Policy. If you use the Service for a company, you confirm that you can bind that company, and “you” means the company.
If you do not agree, do not use the Service. You must be at least 18 years old.
The service
BrainPilot is a crew of AI agents that does marketing work for the projects you set up, for example finding prospects, drafting and sending outreach, handling replies, reporting results and keeping a journal of what was done and why. You decide how much each agent may do on its own through the autonomy levels in the app.
We keep improving the Service and may add, change or remove features. We will not make a change that removes a paid core capability without reasonable notice.
Your account
You need an account to use the Service. Give accurate information, keep your sign-in details secret and tell us at once at [email protected] if you think someone else has used your account. You are responsible for everything that happens under your account, including what the crew does within the autonomy levels and rules you set.
Plans and billing
The Service is sold in plans by number of projects, billed monthly or yearly, as shown on our pricing page. A plan limits how many projects you can run. Every plan includes the whole crew.
Orders are processed by Paddle.com Market Limited (“Paddle”), our merchant of record. Paddle takes payment, calculates and collects any sales tax or VAT, and issues invoices. By buying, you also agree to Paddle’s buyer terms at paddle.com/legal/checkout-buyer-terms.
Plans renew automatically at the end of each billing period until you cancel. If we change a price, the new price applies from your next renewal after we have told you by email at least 30 days ahead. If a payment fails, we may pause your projects until it is paid.
Cancelling and refunds
You can cancel at any time from your account. Cancelling stops future charges and you keep access until the end of the period you have paid for. Refunds are covered in our Refund Policy, which gives you a full refund within 14 days of any charge.
Using the crew
You decide what each agent may do. Where you set an agent to propose, nothing happens until you approve it. Where you set it to act on its own, it acts within the rules and limits you configured. You are responsible for reviewing what you approve and for the settings you choose.
Some safety rules are always on and cannot be switched off: outgoing outreach carries an opt-out, opt-outs are honoured straight away, a never-email list is respected, and the same person is not sent duplicate messages. You may not try to bypass them.
You must give the crew only facts about your project that are true and that you have the right to use. The crew writes from the approved facts you provide.
Email and outreach
When the crew sends email for you, you are the sender and you are responsible for it being lawful. You confirm that you will use the Service for outreach only where you have a lawful basis to contact the person, and that you will follow the email, anti-spam and data protection laws that apply to you and to the people you contact, for example CAN-SPAM, GDPR and PECR.
You will send only from mailboxes and domains you own or are allowed to use, and you will keep them in good standing. If your outreach causes high bounce rates or spam complaints, we may slow, pause or stop sending to protect your domain and ours.
Acceptable use
You agree not to use the Service to:
- Break any law or the rights of others.
- Send spam, deceptive messages, scams, phishing or content that is hateful, harassing, sexual about minors or otherwise illegal.
- Impersonate a person or a company, or mislead people about who is writing to them.
- Contact people who have asked not to be contacted, or add people to outreach without a lawful basis.
- Promote illegal, dangerous or deceptive products or services.
- Attempt to break, probe or overload the Service, reverse-engineer it, or get around its limits and safety rules.
- Resell or share access to the Service without our written permission.
- Use the Service to build a competing product.
Your content
You keep ownership of what you put into the Service: your project facts, files, mailbox content and prospect data, and of the drafts and messages the crew creates for you. You give us the permission we need to host, process and display that content, and to send it to the providers described in the Privacy Policy, only to run the Service for you.
You promise you have the rights needed to give us that content and that it does not break the law or anyone’s rights.
AI-generated work
The agents use AI models. AI can make mistakes: it can write something inaccurate, miss context or misjudge a reply. We build checks into the crew, including a review step before items go out and a decision journal with an undo window, but we cannot guarantee that every output is correct, suitable or free of errors. Review what matters, use the autonomy levels that fit your risk, and do not rely on the output as legal, financial or professional advice.
We do not promise any particular result, such as a number of replies, leads, rankings or sales.
Our property
The Service, including the software, design, the BrainPilot name and logo, and the agents’ names and faces, belongs to us or our licensors. These Terms give you the right to use the Service while your account is active, not to own any part of it.
Third-party services
The Service depends on third parties, such as Paddle, AI model providers, hosting providers and the mail provider of any mailbox you connect. Their own terms apply to the parts they handle, and we are not responsible for their services. If you connect a mailbox, you must follow that mail provider’s terms as well.
Suspension and termination
You can stop using the Service and close your account at any time. We may suspend or end your access if you break these Terms, if your use puts the Service or other people at risk, if a payment is not made, or where the law requires it. Where it is reasonable, we will tell you first and give you the chance to fix the problem.
When an account ends, you lose access to the Service. We delete your data as described in the Privacy Policy. Sections that by their nature should continue, such as ownership, disclaimers, liability and indemnity, continue after the end of these Terms.
Disclaimer of warranties
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we give no warranties of any kind, express or implied, including that the Service will be uninterrupted or error-free, or that it will meet your needs or produce any particular result.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the event that caused the claim.
Nothing in these Terms limits liability that cannot be limited by law, or any rights you have as a consumer under the law where you live.
Indemnity
You agree to defend and cover us against claims, losses and costs that arise from your content, from the outreach you send through the Service, or from your breach of these Terms or the law.
Changes to these terms
We may update these Terms, for example when we add features or change plans. We change the “Last updated” date at the top and, for material changes, tell account holders by email before they take effect. If you keep using the Service after the changes take effect, you accept the updated Terms.
